This paper explores the importance of teaching law students how to engage in a process of “unstructuring” a well-structured problem in order to recapture information about the facts and context of the problem that were de-emphasized as irrelevant in the initial structuring process. By converting a well-structured problem into an ill-structured one, we create the opportunity to restructure what appeared to be an intractable problem in a new and useful way.
